Prequalification Announcement on International Solicitation of Proposals for Detailed Urban Design and Architectural Concept Design of the Launch Area of the Future Science and Technology City of Chengdu Hi-Tech Industrial Development Zone
成都高新區(qū)發(fā)展改革和規(guī)劃管理局作為主辦單位，成都高投建設(shè)開(kāi)發(fā)有限公司作為承辦單位，上海國(guó)際招標(biāo)有限公司作為征集組織機(jī)構(gòu)，現(xiàn)舉辦“成都未來(lái)科技城起步區(qū)深度城市設(shè)計(jì)及重點(diǎn)地段概念建筑方案國(guó)際征集”活動(dòng)，擬面向全球公開(kāi)邀請(qǐng)具有相關(guān)設(shè)計(jì)經(jīng)驗(yàn)的設(shè)計(jì)機(jī)構(gòu)前來(lái)申請(qǐng)應(yīng)征，提交資格預(yù)審申請(qǐng)文件。通過(guò)資格預(yù)審選取5名應(yīng)征人參加征集活動(dòng)，并提交應(yīng)征設(shè)計(jì)方案。
The Reform and Planning Administration Bureau of Chengdu Hi-Tech Industrial Development Zone (as the Sponsor), CDHT Investment Co., Ltd. (as the Organizer) and Shanghai International Tendering Co. Ltd. (as the Solicitation Agency) are now jointly soliciting Proposals for Detailed Urban Design and Architectural Concept Design of The Launch Area of the Future Science and Technology City of Chengdu Hi-Tech Industrial Development Zone. We publicly invite design institutions worldwide with related design experience to participate and submit the Application Documents for Prequalification. Five Participants will be selected through prequalification to participate in the solicitation activities and submit the Design Proposals.
一、 征集背景（項(xiàng)目概況）
The Background of Solicitation（Project Briefing）
為落實(shí)國(guó)家戰(zhàn)略，推動(dòng)成渝地區(qū)雙城經(jīng)濟(jì)圈建設(shè)，以“一城多園”模式合作共建西部科學(xué)城，成都高新區(qū)擬全力打造成都未來(lái)科技城，并就未來(lái)科技城起步區(qū)（即環(huán)18號(hào)線福田站及周邊區(qū)域）向全球優(yōu)秀設(shè)計(jì)機(jī)構(gòu)征集具有前瞻性和創(chuàng)新性的城市設(shè)計(jì)方案及重點(diǎn)地段建筑設(shè)計(jì)方案。未來(lái)科技城起步區(qū)作為率先啟動(dòng)的核心區(qū)域，應(yīng)重點(diǎn)展現(xiàn)具有成都特色的“未來(lái)表達(dá)”，并突破陳規(guī)思維、本地局限、現(xiàn)實(shí)基礎(chǔ)，從國(guó)際化大趨勢(shì)、城市化新進(jìn)程、科技新前沿進(jìn)行謀劃。
In order to implement the national strategies, promote construction of the economic circle of Chengdu and Chongqing city, and cooperate to build the west science city under the guideline of "One city Multiple parks", our goal is to spare no effort to build the Future Science and Technology City of Chengdu Hi-Tech Industrial Development Zone. To achieve these goals, we are now carrying out the international solicitation of innovative urban design schemes and architectural design schemes from excellent global design institutions for the Launch Area of the Future Science and Technology City of Chengdu Hi-Tech Industrial Development Zone (i.e. Futian station of Metro line 18 and surrounding area). The Launch Area of the Future Science and Technology City, as the core area that takes the lead role in the development of the whole city, should focus on displaying the "Future Words" with Chengdu characteristics and breaking through the conventional thoughts, local limitations and existing circumstances, while also follow the trend of internationalization, the process of urbanization and as a frontier of science and technology.
二、 征集方式
Procedures of Solicitation
1. 資格預(yù)審
Prequalification
通過(guò)資格預(yù)審，擇優(yōu)選取5個(gè)應(yīng)征人（含聯(lián)合體應(yīng)征人）參加征集活動(dòng)，并提交應(yīng)征設(shè)計(jì)方案。
Through Prequalification five Participants (including those of the consortium) shall be selected to participate in the solicitation and submit the Design Proposal.
2. 方案評(píng)審
Scheme Evaluation
對(duì)應(yīng)征設(shè)計(jì)方案進(jìn)行評(píng)審，從5個(gè)應(yīng)征方案中評(píng)選出3個(gè)優(yōu)勝方案。
Through evaluation three out of five schemes will be selected and continue to be improved.
3. 中選方案的確定
Final Determination
將方案評(píng)審結(jié)果報(bào)行政主管部門(mén)，最后從3個(gè)優(yōu)勝方案中確定1個(gè)為最終中選方案。
The administrative authority will determine the final winner after reviewing the evaluation report and three improved schemes.
三、 征集內(nèi)容
Scope of Solicitation
1. 總體研究
General Research
研究范圍：北至絳水路，南至大安溪一路，東至金簡(jiǎn)仁快速路，西至淮簡(jiǎn)快速，總面積約4.6平方公里。
Scope of Research:
The scope of research covers approximately 4.6 square kilometers from Jiangshui Road in the north, Da’an River 1st Road in the south, Jinjianren Expressway in the East and Huaijian Expressway in the West.
主要內(nèi)容：應(yīng)征人需對(duì)該片區(qū)規(guī)劃定位、產(chǎn)業(yè)策劃、整體空間結(jié)構(gòu)、功能布局、公共空間與景觀系統(tǒng)等內(nèi)容進(jìn)行研究。
Contents of Research:
Each of the Participants is required to submit a study report containing regional positioning, industrial planning, overall spatial structure, functional layout, public space and landscape system, etc. of the area.
2. 詳細(xì)城市設(shè)計(jì)
Detailed Urban Design
設(shè)計(jì)范圍：北至絳水南一路，南至大安溪生態(tài)綠廊，東至金簡(jiǎn)仁快速路，西至平橋大道（東一線），總面積約1.2平方公里。
Scope of Design:
The scope of design covers approximately 1.2 square kilometers from Jiangshui South 1st Road in the north, Da’an River ecological corridor in the south, Jinjianren Expressway in the East and Pingqiao Avenue (East Line 1) in the West.
主要內(nèi)容：應(yīng)征人需對(duì)該片區(qū)整體規(guī)劃設(shè)計(jì)思路、總體結(jié)構(gòu)、空間布局、公共空間設(shè)計(jì)、城市景觀設(shè)計(jì)、三維形態(tài)設(shè)計(jì)及開(kāi)發(fā)強(qiáng)度安排、綜合交通設(shè)計(jì)、立體慢行系統(tǒng)、地下空間組織、開(kāi)發(fā)時(shí)序以及新思想、新理念、新技術(shù)應(yīng)用管理等方面形成規(guī)劃方案。
Contents of Design:
Each of the Participants is required to submit a planning scheme containing the overall planning and design theme, overall structure, spatial layout, public space design, urban landscape design, three-dimensional shape design and development intensity, comprehensive traffic design, three-dimensional slow-traffic system, underground space organization, development sequence, new themes and ideas, advanced technology and implementation plans of the area.
3. 建筑設(shè)計(jì)
Architectural Concept Design
應(yīng)征人根據(jù)各自城市設(shè)計(jì)方案確定福田站站城一體建筑設(shè)計(jì)范圍并完成概念性建筑方案設(shè)計(jì)，建筑體量總規(guī)模不小于20萬(wàn)平方米。
Participants shall determine the design scope of the urban complex of Futian station according to their own urban design scheme and complete the conceptual architectural scheme design. The GFA shall be no less than 200000 square meters.
4. 方案征集后續(xù)工作
Follow-up work of proposal solicitation
中選設(shè)計(jì)機(jī)構(gòu)需對(duì)概念建筑設(shè)計(jì)方案、景觀設(shè)計(jì)方案以及新工藝、新技術(shù)、新材料的應(yīng)用方案等內(nèi)容進(jìn)行深化（深化深度需滿足主辦方及相關(guān)行政主管部門(mén)要求，具體深化的深度在設(shè)計(jì)任務(wù)書(shū)及提交成果中詳細(xì)約定）以及后續(xù)2年咨詢服務(wù)。
The final winner shall develop the scheme of architectural concept, landscape concept, and the application of new technologies and materials and provide consulting services for the next two years. The depth of scheme development shall meet the requirements of the sponsor and the administrative authority, which will be specified in the Design Assignment.

七、 應(yīng)征人資格要求
Eligibility and Qualifications of Participants
1. 應(yīng)征申請(qǐng)人（以下簡(jiǎn)稱“申請(qǐng)人”）應(yīng)為合法注冊(cè)的法人實(shí)體或由合法注冊(cè)的法人實(shí)體組成的項(xiàng)目聯(lián)合體；
The participating applicant (hereinafter referred to as the “Applicant”) shall be a legal entity that has been legally incorporated in accordance with laws or a project consortium composed of legal entities that have been legally incorporated in accordance with laws；
2. 申請(qǐng)人應(yīng)具有承擔(dān)本城市設(shè)計(jì)和建筑設(shè)計(jì)項(xiàng)目的相關(guān)資格及能力：
The Applicant shall have the relevant qualifications and abilities to undertake the urban design project:
2.1 中華人民共和國(guó)境內(nèi)的應(yīng)征申請(qǐng)人提供能證明其具有承擔(dān)城市設(shè)計(jì)的專業(yè)技術(shù)能力的證明材料，如城鄉(xiāng)規(guī)劃編制資質(zhì)證書(shū)、外商投資企業(yè)城市規(guī)劃服務(wù)資格證書(shū)、建筑行業(yè)（建筑工程）設(shè)計(jì)甲級(jí)及以上的資質(zhì)證書(shū)或城市設(shè)計(jì)的委托合同等；
The Applicants within the People’s Republic of China shall provide certification materials proving that they have the professional and technical abilities to undertake the urban design project, such as a qualification certificate for the urban and rural planning, a Certificate of Qualification of Foreign-funded Enterprises for Urban Planning Services, a qualification certificate of Grade A architectural design (architectural engineering) or above or a commission contract of urban design, etc.；
2.2 中華人民共和國(guó)境外的規(guī)劃設(shè)計(jì)機(jī)構(gòu)須依本國(guó)或本地區(qū)的管理規(guī)定具有城市規(guī)劃或建筑設(shè)計(jì)的執(zhí)業(yè)許可或經(jīng)營(yíng)許可。若依該國(guó)或該地區(qū)有關(guān)城市規(guī)劃和建筑設(shè)計(jì)從業(yè)或營(yíng)業(yè)的管理規(guī)定城市規(guī)劃或建筑設(shè)計(jì)企業(yè)法人應(yīng)具有相應(yīng)執(zhí)業(yè)資質(zhì)或資格或營(yíng)業(yè)許可，則需提供該機(jī)構(gòu)的相應(yīng)資質(zhì)或資格或營(yíng)業(yè)許可證明文件；若依該國(guó)或該地區(qū)有關(guān)規(guī)劃、建筑設(shè)計(jì)從業(yè)或營(yíng)業(yè)的管理規(guī)定，不要求城市規(guī)劃或建筑設(shè)計(jì)企業(yè)法人具有相應(yīng)執(zhí)業(yè)資質(zhì)或資格或營(yíng)業(yè)許可，僅對(duì)規(guī)劃師、建筑師個(gè)人要求具有相應(yīng)資質(zhì)或資格或執(zhí)業(yè)許可，則需提供該機(jī)構(gòu)的規(guī)劃師、建筑師本人的注冊(cè)或執(zhí)業(yè)證書(shū)或會(huì)員證明材料，同時(shí)設(shè)計(jì)機(jī)構(gòu)應(yīng)說(shuō)明該國(guó)或該地區(qū)有關(guān)規(guī)劃和建筑設(shè)計(jì)從業(yè)或營(yíng)業(yè)的管理規(guī)定。港澳臺(tái)設(shè)計(jì)機(jī)構(gòu)的資格要求參照境外設(shè)計(jì)機(jī)構(gòu)資格要求的規(guī)定；
The Applicants outside the People’s Republic of China should have a practice license or business license for urban planning or architectural design in accordance with the national or local administrative regulations. If a business entity engaged in urban planning or architectural design should have the corresponding practice permit or qualification or business license according to the national or local administrative regulations on practice or operation of urban planning and architectural design, it shall provide documentary evidence for its practice permit or qualification or business license. If the national or local administrative regulations on practice or operation of urban planning and architectural design do not require that a business entity engaged in urban planning or architectural design should have the corresponding practice permit or qualification or business license, and only require that planners and architects should have appropriate qualifications or practice licenses, then the registered or practicing certificate or membership certificate of the planner or architect of the institution should be provided, and the design agency should explain the national or regional administrative regulations on practice or operation of planning and architectural design. The qualification requirements for design agencies in Hong Kong, Macao and Taiwan should refer to the provisions on the qualification requirements for overseas design agencies；
2.3 應(yīng)征申請(qǐng)人應(yīng)有與本項(xiàng)目的功能性質(zhì)相類似的城市、建筑設(shè)計(jì)經(jīng)驗(yàn)。
Applicants should have experience in urban design which has similar functions this project.
3. 本項(xiàng)目接受聯(lián)合體申請(qǐng)，聯(lián)合體的成員機(jī)構(gòu)不得超過(guò)3個(gè)：
This project accepts applications from Consortium, and the number of the Consortium members shall not exceed three:
3.1 聯(lián)合體的各成員應(yīng)共同簽署一份聯(lián)合體協(xié)議；
Members of the Consortium shall jointly sign a consortium agreement；
3.2 組成項(xiàng)目聯(lián)合體的各成員單位不得再以自己的名義單獨(dú)申請(qǐng)資格預(yù)審，也不得同時(shí)加入本項(xiàng)目其它聯(lián)合體申請(qǐng)資格預(yù)審；
Any partner of the Consortium shall neither individually apply for the Prequalification in its own capacity, nor concurrently apply for the Prequalification as a partner of another Consortium；
3.3 若聯(lián)合體均由境內(nèi)設(shè)計(jì)機(jī)構(gòu)組成，則需滿足2.1項(xiàng)要求；若聯(lián)合體由境內(nèi)、外設(shè)計(jì)機(jī)構(gòu)（包括港澳臺(tái)地區(qū)）組成，則境內(nèi)機(jī)構(gòu)須至少滿足2.1項(xiàng)其中一項(xiàng)資質(zhì)要求，境外機(jī)構(gòu)（包括港澳臺(tái)地區(qū)）需滿足2.2項(xiàng)要求。
If the Consortium is composed of domestic design agencies, the requirements in Item 2.1 shall be met； if the Consortium is composed of domestic and foreign design agencies (or design agencies from Hong Kong, Macao and Taiwan), the domestic agencies shall meet at least one of the qualification requirements in Item 2.1, and foreign agencies (or agencies from Hong Kong, Macao and Taiwan) shall meet the requirements in Item 2.2.

Applicants who intend to participate in the solicitation for Design Proposals must first download the Registration Form from the website of Shanghai International Tendering Co., Ltd. (www.shabidding.com). After completing the registration form, applicants should email the Word version to yufang@shabidding.com. The deadline for submission of Registration Form is 17:00 on June 10, 2020 (Beijing Time, the same below). The time of submission of registration from is subject to the time when the Registration Form reaches the designated Email box. Registration Forms received after the deadline will not be accepted. After receiving the Registration Form, the Solicitation Agency will send the password of the Prequalification Documents to the applicants.

九、 資格預(yù)審申請(qǐng)文件的遞交
Submission of Application Documents for Prequalification
資格預(yù)審申請(qǐng)文件遞交的截止時(shí)間為2020年6月11日下午17時(shí)00分。申請(qǐng)人應(yīng)在遞交截止時(shí)間之前將全套資格預(yù)審申請(qǐng)文件（紙質(zhì)版和電子版）遞交至征集組織機(jī)構(gòu)。征集組織機(jī)構(gòu)將拒絕接收逾期送達(dá)的資格預(yù)審申請(qǐng)文件。應(yīng)征申請(qǐng)人應(yīng)按資格預(yù)審文件的要求提交申請(qǐng)文件。
The submission deadline of application documents for prequalification is 17:00 on June 11, 2020. The applicant shall submit a complete set of Application Documents for Prequalification (paper and electronic) to the solicitation organization before the deadline for submission. The Solicitation Agency will reject any such documents that arrive after the specified deadline. Applicants should submit the Application Documents for Prequalification in accordance with the requirements of the Prequalification Documents.

十一、 征集說(shuō)明
Instructions on Solicitation
1. 應(yīng)征設(shè)計(jì)補(bǔ)償金
Compensations for Designs Proposals
承辦單位將向按照征集要求提交了有效的方案征集應(yīng)征文件的應(yīng)征人支付應(yīng)征設(shè)計(jì)補(bǔ)償金，金額為人民幣350萬(wàn)元（含稅）。
The Organizer will pay a compensation for Design Proposal to each of the five Participants who have submitted valid proposals in accordance with the solicitation requirements. The amount is RMB 3.5 million (including taxes).
2. 當(dāng)應(yīng)征人出現(xiàn)下列情況時(shí)，承辦單位不予支付補(bǔ)償金：
The Organizer will not pay any compensation when Participants are under the following circumstances:
2.1 應(yīng)征人未按規(guī)定時(shí)間提交應(yīng)征文件；
Participants fail to submit the Design Proposals within the specified time；
2.2 應(yīng)征人提交的應(yīng)征文件經(jīng)專家評(píng)審被認(rèn)定為未對(duì)征集文件要求作出實(shí)質(zhì)性響應(yīng)；
The Design Proposals submitted by Participants are judged, upon the expert review, as not substantially responding to the requirements of the solicitation documents；
2.3 應(yīng)征人被取消應(yīng)征資格；
Participants are disqualified；
2.4 方案征集期間，應(yīng)征人的資格條件發(fā)生變化，不能達(dá)到第七條規(guī)定的應(yīng)征人資格要求。
During the period of solicitation, the qualification conditions of the Participants have changed and cannot meet the requirements of Article 7 Eligibility and Qualifications of Participants.
3. 獎(jiǎng)項(xiàng)和獎(jiǎng)金的設(shè)置：
Awards and prize settings:
本次方案征集設(shè)優(yōu)勝獎(jiǎng)3名，獲優(yōu)勝獎(jiǎng)的應(yīng)征人在按照征集文件的要求，結(jié)合專家意見(jiàn)對(duì)方案進(jìn)行優(yōu)化后，每家將獲得優(yōu)勝獎(jiǎng)獎(jiǎng)金人民幣70萬(wàn)元（含稅）。
There are 3 winners in the scheme collection. After the winner modifies the Design Proposal in accordance with the requirements of the solicitation document and in combination with expert opinions, and meets the requirements of the Sponsor, each winner will receive a prize of RMB 0.7 million (including taxes)..

最終中選的1家應(yīng)征人將承接本項(xiàng)目深化工作（滿足主辦方及相關(guān)行政主管部門(mén)要求，深化的深度在設(shè)計(jì)任務(wù)書(shū)及提交成果中詳細(xì)約定）和后續(xù)2年的咨詢服務(wù)合同，合同金額為人民幣3000萬(wàn)元（含稅）。
The final winner shall develop the schemes of architectural concept, landscape concept, and the application of new crafts, technologies and materials and provide consulting services for the next two years. The depth of scheme development shall meet the requirements of the Sponsor and the administrative authority, which will be specified in the Design Assignment Documents. The contractual amount will be RMB30 million (including taxes).
以上費(fèi)用含中國(guó)境內(nèi)、外應(yīng)繳納的各項(xiàng)稅費(fèi)。

1. 知識(shí)產(chǎn)權(quán)
Intellectual Property Rights (IPR)
1.1 本次方案征集中接收的所有有效的應(yīng)征設(shè)計(jì)成果均不退回。
All valid Design Proposals received in this solicitation will not be returned.
1.2 應(yīng)征人提交的應(yīng)征城市設(shè)計(jì)版權(quán)歸主辦單位/承辦單位所有。應(yīng)征人對(duì)其應(yīng)征的城市設(shè)計(jì)享有署名權(quán)。在征得主辦單位/承辦單位書(shū)面同意后，應(yīng)征人可通過(guò)傳播媒介、專業(yè)雜志、書(shū)刊或其他形式評(píng)價(jià)、展示其應(yīng)征設(shè)計(jì)成果的相關(guān)內(nèi)容。除應(yīng)征人的設(shè)計(jì)標(biāo)準(zhǔn)、設(shè)計(jì)導(dǎo)則和繪圖元素以外，應(yīng)征人不得將應(yīng)征設(shè)計(jì)成果用于其他的規(guī)劃設(shè)計(jì)項(xiàng)目。
The copyright of the applied urban design submitted by Participants belongs to the Sponsor / Organizer, and Participants hold the right of authorship for the applied urban design. Participants can comment on and display the relevant contents of Design Proposals in the forms of media communication, trade magazines, and publications among others upon the Sponsor’s / Organizer’s consent in writing. Except for Participants’ design standards, designing guidelines and drawing elements, the Participants shall not use their Design Proposals in other planning and design projects.
1.3 應(yīng)征人提交的應(yīng)征建筑方案版權(quán)歸主辦單位/承辦單位及應(yīng)征人共有。主辦單位/承辦單位可對(duì)應(yīng)征建筑方案進(jìn)行印刷、出版和展覽，可通過(guò)傳播媒介、專業(yè)雜志、書(shū)刊或其他形式評(píng)價(jià)、展示、宣傳，但應(yīng)注明應(yīng)征建筑方案的設(shè)計(jì)單位和創(chuàng)作者。在征得主辦單位/承辦單位書(shū)面同意后，應(yīng)征人可通過(guò)傳播媒介、專業(yè)雜志、書(shū)刊或其他形式評(píng)價(jià)、展示其應(yīng)征建筑方案的相關(guān)內(nèi)容。
The copyright of the architectural design scheme submitted by Participants belongs to the Sponsor / Organizer and the Participants. The Sponsor / Organizer can print, publish and exhibit the guidance, and can comment on, display and publicize it in the forms of media communication, trade magazines, publications among others, but should indicate the design organizations and creators of the guidance. Participants can comment on and display the relevant contents of the architectural design scheme in the forms of media communication, trade magazines, and publications among others upon the Sponsor’s /Organizer’s consent in writing.
1.4 主辦單位/承辦單位有權(quán)在本項(xiàng)目的規(guī)劃編制、城市設(shè)計(jì)編制、城市設(shè)計(jì)導(dǎo)則編制、建筑方案編制、城市運(yùn)營(yíng)、園區(qū)商業(yè)運(yùn)營(yíng)、土地出讓、規(guī)劃建設(shè)管理等情形中無(wú)償全部或部分使用應(yīng)征人提交的設(shè)計(jì)成果。
The Sponsor / Organizer has the right to use all or part of the Design Proposals free of charge in the formulation of the planning, urban design, urban design guidelines, and architectural proposal guidance as well as urban operation, Park commercial operation, land transfer, planning and construction management of the project.
1.5 應(yīng)征人應(yīng)保證提交的應(yīng)征設(shè)計(jì)成果在中國(guó)境內(nèi)或境外沒(méi)有且不會(huì)侵犯任何其他人的知識(shí)產(chǎn)權(quán)（包括但不限于著作權(quán)、專利權(quán)）或?qū)Ｓ屑夹g(shù)或商業(yè)秘密。應(yīng)征人應(yīng)保證，如果其應(yīng)征設(shè)計(jì)成果使用或包含任何其他人的知識(shí)產(chǎn)權(quán)或?qū)Ｓ屑夹g(shù)或商業(yè)秘密，應(yīng)征人已經(jīng)獲得權(quán)利人的合法、有效、充分的授權(quán)。應(yīng)征人因侵犯他人知識(shí)產(chǎn)權(quán)或?qū)Ｓ屑夹g(shù)或商業(yè)秘密所引起的全部賠償責(zé)任應(yīng)由應(yīng)征人承擔(dān)。
Participants shall ensure that all the submitted Design Proposals have not infringed upon and will not infringe upon IPR (including but not limited to copyright and patents) or proprietary technologies or trade secrets of others within or outside the People’s Republic of China. Participants shall guarantee that if their Design Proposals use or include IPR or proprietary technologies or trade secrets of others, Participants shall have already obtained legitimate, valid and sufficient authorization from the right holders. Participants shall take all liabilities arising from infringement by the Participants upon IPR or proprietary technologies or trade secrets of others.
1.6 在征集過(guò)程中主辦單位提供的設(shè)計(jì)基礎(chǔ)資料（包括設(shè)計(jì)圖紙、設(shè)計(jì)資料等）的知識(shí)產(chǎn)權(quán)屬主辦單位及相關(guān)設(shè)計(jì)單位所有。應(yīng)征人僅可以將上述文件用于應(yīng)征設(shè)計(jì)和編制應(yīng)征設(shè)計(jì)文件之目的。未經(jīng)主辦單位書(shū)面許可，應(yīng)征人不得將上述文件用于其他工程設(shè)計(jì)或其他目的，也不得將上述文件泄露給任何第三方。
The IPRs of the basic design information (including design drawings, design materials, etc.) provided by the Sponsor during the solicitation process belong to the Sponsor and related design organizations. Participants can only use the documents aforementioned for the purpose of designing and compiling Design Proposals. Without written consent from the Sponsor, Participants shall not use the documents aforementioned for other engineering designs or other purposes, and shall not disclose the documents aforementioned to any third Party.
1.7 所有由應(yīng)征人編制的成果文件，其著作權(quán)歸應(yīng)征人所有。承辦單位與應(yīng)征人簽訂中選合同后，主辦單位/承辦單位獲得成果文件的使用權(quán)。
The copyright of all the outcome documents prepared by the participant shall be owned by the participant. After the organizer and the participant sign the winning contract, the sponsor/organize obtains the right to use the outcome documents.
1.8 該項(xiàng)目初步設(shè)計(jì)、施工圖設(shè)計(jì)將按照《中華人民共和國(guó)招標(biāo)投標(biāo)法》規(guī)定公開(kāi)招標(biāo)確定設(shè)計(jì)單位。
The design development and construction drawing design of the project will be determined through public bidding in accordance with the bidding law of the People’s Republic of China.
2. 適用法律

本次征集活動(dòng)本身及與本次活動(dòng)相關(guān)的文件所適用的法律和法規(guī)僅為中華人民共和國(guó)的法律和法規(guī)。
The solicitation per se and any documents relating thereto shall be governed only by the laws and regulations of the People’s Republic of China.
3. 語(yǔ)言
Languages
3.1 資格預(yù)審文件以及與資格預(yù)審文件相關(guān)的補(bǔ)充文件和澄清文件均使用中文和英文書(shū)寫(xiě)。在中、英文兩種語(yǔ)言的意思表達(dá)不一致時(shí)，以中文為準(zhǔn)。
The language used in the Prequalification Documents and any supplement and clarification documents thereto shall be Chinese and English. In the event of any discrepancy between Chinese and English, Chinese shall prevail.
3.2 資格預(yù)審申請(qǐng)文件與主辦單位之間與征集活動(dòng)有關(guān)的往來(lái)函電和文件均應(yīng)使用中文書(shū)寫(xiě)。應(yīng)征人隨應(yīng)征文件提供的證明文件和印刷品可以使用另一種語(yǔ)言，但必須附以中文譯本。
Application Documents for Prequalification and the correspondence and documents related to this solicitation between Participants and the Sponsor shall all be drafted in Chinese. Another language can be used for the proof documents and printed materials that Participants provide along with the application documents, but the version with Chinese translation shall be attached thereto.
3.3 與本次征集活動(dòng)相關(guān)的會(huì)議及各項(xiàng)活動(dòng)的口頭交流的語(yǔ)言為中文。
The language used in the meetings and oral communication related to this solicitation shall be Chinese.

本次征集活動(dòng)及相關(guān)文件的最終解釋權(quán)歸主辦單位。
